These Terms and Conditions (“Terms”) govern your use of the Thomas Hirschark Bank Seized Cars website and any purchases of vehicles from us. By accessing the site or buying a vehicle, you agree to these Terms. If you don’t agree, do not use the site or buy from us.

1. About Us and Our Services We offer bank-seized vehicles for sale online. All sales are final unless stated otherwise in our purchase agreement. Vehicles are sold “as-is, where-is” with all faults.

2. Eligibility You must be 18+ and legally able to enter contracts. If buying as a business, you represent that you have authority.

3. Inventory and Pricing

• Listings show photos, descriptions, mileage, and history reports (when available). We aim for accuracy but rely on third-party data.
• Prices exclude taxes, title/registration fees, shipping, and any dealer/doc fees (quoted separately).
• We reserve the right to correct errors in pricing or descriptions. Vehicles subject to prior sale.

4. Purchase Process

• Select vehicle, review details, complete secure payment.
• We coordinate shipping with certified carriers (costs quoted upfront).
• Title transfers per state laws; you handle registration.

5. “As-Is” Sale – No Warranties All vehicles are sold AS-IS with NO WARRANTIES, express or implied, including merchantability or fitness for a particular purpose. We do not guarantee condition, mileage accuracy, accident history, or future performance. Inspect (virtually or in-person if arranged) before buying. We provide history reports when available, but they’re not guarantees.

6. Inspection and Returns We offer a 7-day post-delivery inspection period. If the vehicle materially differs from the listing (e.g., major undisclosed damage), contact us immediately. Returns may be accepted at our discretion (you pay return shipping unless our error). No returns after 7 days or for buyer’s remorse.

7. Shipping and Delivery Shipping is arranged through third-party carriers. We provide tracking but are not liable for delays, damage in transit, or carrier issues (carrier’s insurance applies). Title risk passes on delivery.

8. Payment and Fees Payments via secure methods. All sales final. No refunds except as noted in Section 6. Late payments may incur fees.

9. Limitation of Liability We are not liable for indirect, consequential, or punitive damages from use of the site or vehicles. Our total liability is limited to the purchase price.

10. Governing Law These Terms are governed by the laws of the State of Vermont, without regard to conflict of laws. Disputes resolved in courts located in Chittenden County, Vermont.

11. Changes We may update these Terms. Continued use means acceptance.
